Major League Bloggers, defines itself as a “distributor” under tort liability for communicators and is therefore not liable for libel, slander, defamatory content, or any other violations of federal law until notified by the offending party and/or the attorney of said party, but does retain copyright to any and all publications jointly with the author. Said “co-copyright” does not include in any form an XML feed of the MLBLoggers.com/writer publications on MLBLoggers being pulled to another website, device or company either upon monetary agreement with MLBLoggers or through more traditional means as a blog reader. Major League Bloggers then by law becomes liable for such content and has a “reasonable amount of time” to either publish a retraction and/or take down the offending material. Major League Bloggers will work closely with those who suspect any illegal content to come to an amicable conclusion. IMPORTANT NOTICE: TO BECOME AN AUTHORIZED USER OF Major League Bloggers, YOU MUST AGREE TO THE TERMS OF THIS MEMBERSHIP AGREEMENT. IF YOU DO NOT AGREE TO THE TERMS OF THIS MEMBERSHIP AGREEMENT, YOU SHOULD NOT ACCESS THE WEBSITE.

THE SERVICE. Major League Bloggers is an online confederation of sports sites featuring columns, news, analysis and comment by writers for Major League Bloggers. The content, services and hours of operation of Major League Bloggers may be expanded, restricted, updated or otherwise changed by MLBoggers in its sole discretion at any time.

PROPRIETARY RIGHTS. All content included on this site is the property of MLBLoggers and it's respective owner and is protected by copyright and other laws relating to proprietary rights, but also is identified as a distributor under tort liability law. All software used on this site is the property of MLBLoggers or its software suppliers and is protected by copyright and other laws. MLBLoggers and its content providers and software suppliers retain all rights in their respective properties worldwide.

LIMITATIONS ON USE. Your use of Major League Bloggers is expressly subject to the restrictions set forth below. If MLBLoggers detects or becomes aware of any failure to comply with any of these restrictions or becomes aware of any actions, which are in violation of its publishing partners’ copyrights, it will take immediate action which can include terminating Your access to Major League Bloggers immediately and banning future access.

You may not reproduce, retransmit, distribute, disseminate, sell, license, sublicense, lease, publish, broadcast or circulate any content or other materials accessed through Major League Bloggers, except in accordance with the fair use doctrine under the copyright laws of the United States.

You may not permit the delivery of any content in violation of any applicable United States or Territory export control laws, restrictions and regulations relating to the distribution of technical information, as they exist from time to time, including, without limitation, those promulgated by the United States Department of Commerce; or, with respect to materials which You are allowed to post on the Major League Bloggers website.

USAGE FEES. At present we are pleased to offer access to MLBLoggers free of charge. While we have absolutely no plans for that to ever change, we reserve the right to do so.

Adsense advertising. There is a revenue sharing plan to share a percenmtage of adsense ad revenues with the author of the content. The percentage may change over time and users will be alerted on the website to any changes of this policy. At this time the revenue share will be 75% for the author and 25% for MLBloggers. Authors need to have a valid Adsense account and enter it or they will forfeit their percentage.

DISCLAIMERS. Major League Bloggers AND ITS CONTENT ARE BEING PROVIDED “AS IS” WITHOUT ANY WARRANTIES OF ANY KIND. MLBLoggers, ITS AFFILIATES, AGENTS EMPLOYEES, DIRECTORS, AND SUPPLIERS EXPRESSLY DISCLAIM ANY SUCH WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, FREEDOM FROM INFRINGEMENT OR FREEDOM FROM VIRUSES. MLBLoggers DOES NOT WARRANT THAT THE OPERATION OF Major League Bloggers WILL BE ERROR FREE OR WITHOUT INTERRUPTION. ALL LIABILITY WITH RESPECT TO THE ACCURACY, RELIABILITY AND/OR QUALITY OF THIRD PARTY CONTENT SHALL REMAIN WITH THE RESPECTIVE CONTENT PROVIDER, AND YOU SHALL HAVE NO REMEDY AGAINST MLBLoggers WITH RESPECT TO THE SAME.
